TERMS AND CONDITIONS

Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:

 

 

Country refers to: Australian Capital Territory, Australia

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to ‘GLAMOURIZE By Jasmine Lee’ (GLAMOURIZE).

Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.

 

Orders/Bookings mean a request by You to purchase Services from Us.

Personal Data is any information that relates to an identified or identifiable individual.

For the purposes for GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity

Promotions refer to contests, sweepstakes, discounts, or other promotions offered through the Service.

Service refers to the Website, Makeup Artist Services, and Personal Styling Services.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors.

Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Website refers to Glamourize By Jasmine Lee, accessible from https://glamourize.com.au/

You means the individual, client, customer, group booking, bridal party, accessing or using the Service, or a company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

All dealings, including contracts, engagement (deposit fees), refunds, and Services that occur between You and Glamourize By Jasmine Lee (GLAMOURIZE) and any other individual that is related to any goods or services provided/supplied by GLAMOURIZE through Our Website glamourize.com.au are subject also to the Terms and Conditions.

By accessing or using the Service, You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service, You will require a parent or guardian to complete the payment and provide signed consent. If You are seeking school formal makeup for example, and You are under the age of 18 We would require an legal adult parent or guardian to engage Our Service on Your behalf. 

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

Glamourize has the right to remove or vary these Terms at any time without notice. It is the Client’s responsibility to be aware of any changes made to these Terms and by continuing to use and visit the Website the Client agrees to be governed by these Terms and Conditions.

GLAMOURIZE reserves the right to withdraw the Services without notice and will NOT be liable (if for any reason) the Website is unavailable or offline during any period.

By placing an Order for Services through Our Service, You warrant that You are legally capable of entering into binding contracts.

Your Information

If You wish to place an Order Services available, You may be asked to supply certain information relevant to Your Order/Booking Request including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your event or wedding location information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.

By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.

Deposit – A non-refundable 30% booking fee (and signed contract in certain circumstances – at GLAMOURIZE’s discretion) are required to secure Client’s appointment date & time for all bookings, transferred to the specified GLAMOURIZE bank account.

Last minute bookings (i.e. booking confirmed 24-48 hrs prior to the event) – will require a full payment to be transferred to the specified GLAMOURIZE bank account upon confirming the booking at Our discretion.

Event Final Payment – The Client will be responsible for payment of the remaining balance to be received within 10 business days prior to the event OR 4 business days after the event with permission from GLAMOURIZE. This allows for a total of 14 business days with reasonable and sufficient time for a client to finalise their remaining balance.

Wedding Final Payment – For weddings the remaining balance must be finalised and received within 30 business days before the date of the wedding.

Commercial Work Payment – Your booking confirmation is considered a verbal or written agreement. The makeup artist has made themselves exclusively available by not engaging other work to prioritise Your booking.

You will be invoiced upon completion of the booking. Payment must be received within 14 days. Cancellations within 48 hours notice will incur the full fee and You will be invoiced. Payment must be received within 14 days.

ALL FINAL PAYMENTS – Are to be made by paying via bank transfer to a specified GLAMOURIZE bank account or by cash on the day of the Service in person. We are currently exploring the ability to include PayPal and Credit Card Facility via our website in future but this service may or may not be available at the time of Your booking or appointment.

Scheduling – Confirmed numbers upon booking are final, should You wish to change the amount of people in Your group booking this must be done 11 business days prior to Your event. All ‘last minute booking’ numbers are final. If You or one of Your group are unable to attend, transfer of Services may be granted to a replacement person at the original time allocated for Your event or wedding but payment will not be refunded. Refunds are not available for change of mind.

Re-scheduling – In most circumstances, re-scheduling is often deemed as a cancellation, please see Our cancellation section for more information. However, if re-scheduling 14 days prior to Your event date, Or using a ‘Extended Holding Deposit’ option due to government action such as a lockdown the booking fee will be able to be transferred to the next foreseeable date. If there is no appropriate re-schedule date, the booking fee will not be refunded. Our makeup artist will try to re-schedule with however We cannot guarantee availability.

Sometimes cancellations are unavoidable.

COVID-19 or GOVERNMENT ACTION

In the event of a confirmed government lockdown or Natural Disaster that may prohibit our ability to deliver Our Service – We may be able to refund Your deposit to Your preferred bank account provided products and materials have not already been allocated (standard bank transfer times will apply). As a guide, should a lockdown occur less than a week from Your date We may need to charge the non-refundable deposit for materials.

However, We can also hold the deposit and reschedule for You at the next foreseeable date. Keep in mind, rescheduling can be extremely advantageous. In Our experience, everyone who is impacted generally in this lockdown situation wants to rebook at the earliest possible convenience so this ‘extended holding deposit’ option can be wise.

In the event there is a change of mind, acts of god (i.e. adverse weather conditions), or cancellation due to a clients preferences or unforeseen circumstances the 30% booking deposit is non-refundable. We need to cover the cost of obtained products and reduce the loss from an opportunity cost perspective from missing out on other potential customers at that time. 

INABILITY TO PERFORM OUR SERVICES

In the event We cannot facilitate Our Service due to our own fault such as illness, injury, or unforeseen business impact – We will refund your deposit to Your preferred Australian bank account (standard bank transfer times will apply). In the event of sickness, accident, dangerous travel conditions or other reasons beyond Our control, that GLAMOURIZE is subjected to unavailability, efforts will be made to;

  • Immediately give notice to the Client
  • Assist in finding other arrangements if possible
  • The Refund or credit will be given based on a reasonably accurate percentage of services rendered.
  • GLAMOURIZE will not be liable for any costs incurred in finding other arrangements.

REFUSAL OF SERVICES

For the safety of all of Our clients, Our Makeup Artist, Our Business Practice, and Our Equipment, GLAMOURIZE reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

  • Anyone showing abusive and aggressive behaviour, verbal, or physical.
  • Anyone showing cold or flu like symptoms.
  • Anyone with an Infectious disease such as but not limited to, conjunctivitis, cold sores, and skin infections.
  • If fraud or an unauthorized or illegal transaction is suspected.
  • If the Makeup Artist deems that the travel conditions are too dangerous to drive to and from.
  • If the Makeup Artist deems the work environment is not at adequate, sanitary or has poor safety standards.
  • Goods/Service availability
  • Errors in the Clients description for Goods/Services
  • Errors in Your Order including misleading information or inaccurate confirmation of people required for service.

In all of the above ‘REFUSAL OF SERVICES’ instances the Artist reserves the right to refuse their services and the deposit or full payment will not be refunded or transferrable. If cancellation of the booking or change of date occurs within 60 days of a wedding booking, 100% of fee will not be refunded and full payment is required.

Time Management

It is of paramount importance that You are aware of Your responsibilities as Our client to be ready for appointment times. Should unforeseen instances occur whereby You or Your Group or Wedding Party is delayed the onus is on the Client to advise GLAMOURIZE as soon as possible. GLAMOURIZE will not be held responsible or liable for any delays that subsequently delay the completion of Service for any scheduled event.

If You or Your Group is running late for your appointment you will be invoiced at $40 per half hour for every 30 minutes late. A ‘no-show’ with no confirmed contact made will require Our Makeup Artist to leave after approximately 1 hour from the local area at the scheduled appointment time – resulting in a $80 late fee.

Please be aware, aside from wedding appointments and certain commercial work (which are exclusive client calendar appointments) there is a possibility Our makeup artist has multiple appointments that day. In which case, Our makeup artist may not be able to perform Our Service if You are running late beyond 1 hr. Your Booking fee will not be refunded. If You have paid a remaining balance refunds will only be applicable in accordance with our Cancellation Policy. In most circumstances, a full fee will not be refunded or be invoiced in this instance. We aim to arrive 15 minutes early to all appointments, however, will not be held responsible or liable for unforeseen delays outside of Our control. It is a Our discretion to wait until to You arrive beyond 1 hr provided contact has been made, If Our makeup artist is happy to wait and has no other bookings, the $40 per half hour late fee will still apply until You arrive.

Touch up Services (Weddings) – This service is based on hours set for GLAMOURIZE to be available to Client’s timeframe needed. This means any travel and time in between ceremony, photos & reception Artist must stay close by and available and this is part of the hourly rate. It is not possible to start and pause between bridal party being ready and the completion of Artist’s services.

Once bridal party makeup is complete touch up services will commence. The minimum starting package is 2 hours, then depending on length of time needed to stay for touch up services an hourly rate will be set. If required to travel to a 2nd location for touch up services a travel and set up fee will be added to the cost of the starting package. This is all to be agreed upon in Client’s contract prior to wedding day.

Photography – GLAMOURIZE may be taking photographs at various sessions. We may request to feature Our work of consultations, previews, and/or wedding photo(s) to be used for Our digital and/or print portfolios, website, social media pages, and promotions. Unless explicitly opting out through your own initiative, We may ask for Your permission to use such images at Our own full discretion for promotional purposes, in which case We may ask You sign an exclusive release form. In the event there is only a verbal or agreement received via email, text, or phone call or otherwise, You may request We remove photography at a later stage but must provide Us with 30 days notice upon lodging the request and an additional 90 days timeframe to remove images to the best of our reasonable ability on our website and social media. We accept no responsibility or liability for images to be shared or distributed by third-parties before or after these timeframes.

Promotions – Any Promotions made available through the Service may be governed by rules that are separate from these Terms. If You participate in any Promotions, please review the applicable rules as well as our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply. Group and Bridal Party packages are not promotions and should not be considered as such.

Intellectual Property – The Service and its original content (excluding Content provided by You or other users, or commercially free licenses), features and functionality are and will remain the exclusive property of the GLAMOURIZE. The Service is protected by copyright and other laws of both the Country and foreign countries. Our trademarks, logo, and trade dress may not be used in connection with any product or service without the prior written consent of GLAMOURIZE By Jasmine Lee.

Your Feedback to Us – You assign all rights, title and interest in any Feedback You provide GLAMOURIZE. If for any reason such assignment is ineffective, You agree to grant GLAMOURIZE a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Links to Other Websites – Our Service may contain links to third-party web sites or services that are not owned or controlled by GLAMOURIZE. GLAMOURIZE has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that GLAMOURIZE shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Disputes Resolution – If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting GLAMOURIZE By Jasmine Lee.

Severability – If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver – Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation – These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.

Changes to These Terms and Conditions – We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Errors & Inaccuracies – We are constantly updating Our offerings of Our Service. We cannot and do not guarantee the accuracy or completeness of any information, including prices, promotional images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Health & Safety – GLAMOURIZE adheres to a high standard of health, work, and safety when conducting our services. We use Our own supplies and equipment. It is the Client’s responsibility to disclose upon booking confirmation and enquiry of any product preferences. We cannot guarantee We can supply all requests but will attempt to do so if possible or work with You to find a suitable solution. The Client must be able to provide a safe and suitable work environment for the makeup artist. There must be safe access to a power supply, adequate natural lighting, clean conditions, and basic ammenities available such as bathrooms/toilets.

Allergies/ Special Needs – We are trained to discuss and assess with every client their skin, their individual needs, and any allergies they may have. We confirm with all customers, that to the best of their knowledge, that they have not had any skin reactions or allergies prior to application of cosmetic products. In the event a customer has a pre-existing known allergy We will require a doctor or skin specialist recommendation for appropriate products to be as safe as possible.

We are happy to work with anyone, including customers with disabilities or special needs. We do require that in this instance that this is disclosed prior to the booking by the customer to assess if a support person is required or any other considerations will need to be made to accomodate their needs as best We can.

In both instances, You agree by engaging Our Services that GLAMOURIZE (Glamourize By Jasmine Lee) will not be held accountable or be held personally liable for any injury, illness, or adverse reaction (known or unknown) as a result of providing our Service. 

We encourage You to discuss with us any concerns you may have regarding cosmetic products. We also recommend You do your own research and if You are unsure – It is Your responsibility to seek out medical health professionals and skin specialists for advice before testing various cosmetic products.

GLAMOURIZE By Jasmine Lee (GLAMOURIZE) is not liable for any damages to property and/or personal belongings of the client or establishment where the service takes place.

Notwithstanding any damages that You might incur, the entire liability of GLAMOURIZE and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or Your initial deposit through the Service.

To the maximum extent permitted by applicable law, in no event shall GLAMOURIZE or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if GLAMOURIZE or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party’s liability will be limited to the greatest extent permitted by law.

Images used on the website or Our social media pages for marketing purposes are either protected under fair use,  commercially free licensing, under permission of clients for portfolio purposes, or author’s own published photography. Not all of the images contained therein of models’ makeup should necessarily be construed as makeup work performed by Glamourize by Jasmine Lee. Several looks can be closely replicated upon request, much like a hair salon has examples of photography for client inspiration but actual results may vary depending on complexion, skin type, and available products. Our website is still quite new and gradually over time clients can expect to see gradual transitions from several stock images to portfolio and professionally sourced photography from various contract work. We are currently in the process of assembling and designing a new look for high quality images to be displayed on both our website and a dedicated collection portfolio. We will be working closely with previous clients who have given permission to publish photography, professional photographers, and media experts to ensure our updated collections are optimised for web, tablet, and mobile devices. It’s a work in progress, so keep an eye out for updates!!

When You pay for a product and/or a service via bank transfer, We may ask You to provide information to facilitate this transaction and to verify Your identity. Such information may include, without limitation:

  • Date of birth
  • Passport or National ID card
  • Bank card statement
  • Other information linking You to an address

Usage Data

Usage Data is collected automatically when using the Service.
